This document (together with all documents mentioned herein) establishes the terms and conditions governing the use of this website – www.biruintaolteniei.ro (hereinafter "the website").


The purpose of the website is the presentation, promotion, and marketing of BIRUINȚA OLTENIEI COOPERATIVA AGRICOLĂ brand products and contracting, through the website, with potential customers interested in these products.


Please read these Terms and Conditions, the Cookie Policy, and the Privacy Policy before using the website. By accessing and using the website, you expressly acknowledge the binding nature of these documents and undertake to comply with them.



  1. DESCRIPTION OF ACTIVITY

BIRUINȚA OLTENIEI COOPERATIVA AGRICOLĂ with its headquarters at 8 IAS-ului Street, Redea, Olt. Working point: 115 Principala Street, Ulmet village, Dobrun commune, Olt, identified by CIF RO 39545542, registered with the Trade Register under no.: C28/23/2018, is a grain producer and processor.

  1. TERMS
  1. Seller – BIRUINȚA OLTENIEI COOPERATIVA AGRICOLĂ.
  2. Buyer – can be any natural person over the age of 16 or a legal person or any legal entity that places an Order.
  3. Visitor – can be any natural person over the age of 16 or a legal person or any legal entity that visits the website but does not place an order.
  4. My Cart – a section of the Website that allows the Buyer to add Goods they wish to purchase at the time of adding or at a later time;
  5. Site – the online store hosted at the web address www.biruintaolteniei.ro;
  6. Order – an electronic document that serves as a form of communication between the Seller and the Buyer through which the Buyer transmits to the Seller, via the Site, their intention to purchase goods;
  7. Goods – any product listed on the Site, including the products mentioned in the Order, to be provided by the Seller to the Buyer as a result of the concluded Contract.
  8. Campaign – the action of displaying for commercial purposes a finite number of Goods having a limited and predefined stock, for a limited period of time established by the Seller.
  9. Contract – represents the distance contract concluded between the Seller and the Buyer, without the simultaneous physical presence of the Seller and the Buyer.
  10. Opinion/Review – represents a personal evaluation by an owner or beneficiary of a good, written based on the experience of using it with the aim of conveying whether or not the good complies with the specifications mentioned by the Seller. Each opinion also includes the possibility of expressing the degree of satisfaction with the product through an evaluation in the form of a score from one star to five stars.
  11. Commercial communications / newsletter – represents any type of message sent (e-mail, telephone, mobile push, web push, etc.) containing general and thematic information, information regarding products similar or complementary to those purchased from the site, information regarding offers or promotional prices, information regarding Products added to the My Cart section.



3.  GENERAL CONDITIONS

3.1. By registering an Order on the Site, the Buyer agrees to the form of communication (telephone or e-mail) through which the Seller carries out its commercial operations.

3.2. All products sold on our SITE are original and will be delivered in appropriate packaging, accompanied by an invoice, according to current legislation.

3.3. The images of the products presented on the site are for informational purposes. For more details about product characteristics and other additional information, please contact us.

3.4. The sales prices of the products are displayed on the site and are expressed in lei and include VAT. Sales prices do not include courier fees. Product sales prices may change without prior notice to Visitors. For any order placed and confirmed, the Buyer will always pay the prices existing on the site at the time of placing the order.

3.5. Placing an order by the Buyer and its acceptance by the Seller is equivalent to concluding a contract, according to the legislation in force. The notification received by the Buyer, via e-mail, immediately after placing the order, is for informational purposes and does not represent order confirmation.

3.6. The contract is considered concluded between the Seller and the Buyer at the moment the Buyer receives the shipment notification of the Order from the Seller via e-mail. The transfer of ownership rights over the ordered products takes place when the order reaches the Buyer and they fulfill their payment obligation.

3.7. The Seller may refuse to honor an order or may cancel it unilaterally if the Order was placed by a person who has manifested a hostile attitude, likely to prejudice the Seller. In any of these cases, the Buyer may contact the Seller to be informed regarding the reasons that led to the application of the aforementioned measures.

3.8. For justified reasons, the Seller reserves the right to modify the quantity of Goods in the Order. If the Seller modifies the quantity of Goods in the Order, it will notify the Buyer at the e-mail address or telephone number provided to the Seller when placing the Order and will refund the paid amount.

3.9. All information on the Site www.biruintaolteniei.ro is the intellectual property of BIRUINȚA OLTENIEI COOPERATIVA AGRICOLĂ according to the Law for the protection of copyright (Law no. 8/ 1996). All content published on the site (text, product descriptions, images, logo, colors, slogan, symbols, web graphic elements, video clips, etc.) may only be used for the purpose of informing Visitors and Buyers of BIRUINȚA OLTENIEI COOPERATIVA AGRICOLĂ.

3.10. Photos displayed on the SITE, edited or processed by BIRUINȚA OLTENIEI COOPERATIVA AGRICOLĂ, cannot be taken or used without its consent;

3.11. BIRUINȚA OLTENIEI COOPERATIVA AGRICOLĂ is not liable for any color differences that may appear when viewing on various electronic devices (desktop/tablet/mobile) of Visitors/Buyers.

3.12. Any action: project, event, campaign, contest, service, etc., carried out by the company through the site will be announced, promoted, and detailed at the time of its performance, either through a Regulation or through brief and clear provisions inserted within the announcement of that action or subsequently, at the appropriate time.

3.13. The Seller assumes the right to change, modify, or update the content of the SITE www.biruintaolteniei.ro as well as the Terms and Conditions of use at any time, without prior notice.

3.14. It is strictly prohibited and punishable by law to copy, distribute, publish, transmit to other persons, or incorporate the content into other materials outside the site www.biruintaolteniei.ro, without the consent of BIRUINȚA OLTENIEI COOPERATIVA AGRICOLĂ.

4. ACCESS TO THE SITE

4.1. Access to the site is exclusively through the public domain: www.biruintaolteniei.ro

4.2. By accessing and using the Site, the Visitor/Buyer agrees to the terms and conditions presented on the SITE, the privacy policy, and the cookies policy.

4.3. The Visitor/Buyer benefits from limited access, for personal interest (viewing, information, placing online orders) on the SITE www.biruintaolteniei.ro and does not have the right to download, partially or fully modify the SITE, reproduce the SITE partially or fully, copy, sell/resell, or exploit the SITE in any other manner for commercial purposes or purposes that contravene the interests of BIRUINȚA OLTENIEI COOPERATIVA AGRICOLĂ.

4.4. Communication with the Seller can be achieved through direct interaction via the addresses mentioned in the "contact" section of the Site. The Seller is free to manage the information received without having to provide justifications for it.

4.5. All information used for describing the Goods available on the Site (static / dynamic images / multimedia presentations / etc.) does not represent a contractual obligation on the part of the Seller, these being used exclusively for presentation purposes.


5. OBJECT OF THE CONTRACT

5.1. The object of the contract is the sale of the good(s) ordered on the site by the Buyer. The contract is considered concluded at the moment of acceptance by the Seller and the transmission of the order shipment notification.

5.2. The transfer of ownership rights over the ordered product(s) takes place when the order reaches the Buyer at the place indicated by them in the Order, when they fulfill their payment obligation and sign for receipt on the document provided by the courier company.

5.3. The Seller will include in the package sent to the Buyer the necessary documents certifying the purchase of products by the Buyer.


6. THE ORDER

6.1. The Buyer can place Orders on the Site by adding the desired Goods to the shopping cart, then finalizing the Order. Once added to the shopping cart, a Good is available for purchase to the extent that there is available stock for it. Adding a Good, in the absence of finalizing the Order, does not entail the registration of an order, nor the automatic reservation of the Good.

6.2. By finalizing the Order, the Buyer consents that all data provided by them, necessary for the purchase process, are correct, complete, and true at the date of placing the Order.

6.3. By finalizing the Order, the Buyer consents that the Seller may contact them through any means available / agreed upon by the Seller, in any situation where contacting the Buyer is necessary.

6.5. Order cancellation: In the following cases, the Seller may unilaterally cancel an Order, without the obligation for any party to subsequently claim damages from the other party:

  • the data provided by the Buyer is incorrect or incomplete;
  • the transaction is not accepted by the Buyer's card-issuing bank, in case of online payment;
  • the transaction is not validated by the card processor agreed upon by the Seller, in case of online payment;
  • in the order history, the Buyer appears to have more than two consecutive failed deliveries for reasons independent of the Seller;
  • the Buyer's activity on the SITE may produce damages of any nature to the Seller;
  • in case of a suspicious transaction or one declared suspicious by a banking unit, institution, or authority;
  • in case of other objective reasons.

The Buyer can cancel an Order in the following cases:

  • at the moment they are contacted by the company representative, if for certain reasons they no longer want the ordered products;
  • in writing at the e-mail address: comenzi@biruintaolteniei.ro or by telephone until receipt of the order shipping e-mail, which confirms the receipt of the package(s) by the courier company to deliver it to the Buyer's address.

6.6. For any order cancelled exclusively due to the Buyer's fault, the Buyer will pay the cost of the courier services.

6.7. If a product is not available in stock, the Buyer will be informed either by e-mail or by telephone by the company representative. In this case, the Buyer will be informed of the new delivery time, and they can decide to wait until all ordered products are delivered or to cancel the order.

6.8. How to place an order: You can search the site for the desired products using the "Search" button or by navigating through the categories and subcategories appearing on the site.

  • To place an online order, you will need to select the products and the desired quantity (using the plus - minus signs) and add them to the cart by pressing the "Add to cart" button.
  • To send the order, the next step will be to enter "My Cart" by clicking on the icon in the top right or by clicking on "View cart".
  • Here you will be able to see the complete list with all the products you have selected to buy.
  • You can modify the desired quantity for each product (using the plus - minus signs) or you can delete products.
  • To proceed to the next step, you will need to press the "Finalize order" button.

6.9. Order finalization: To register the order, you will need to enter your data.

6.10. You have the option of quick check-out through shopPay or Gpay, where you will be asked to enter your e-mail address.

6.10. You have the option to fill in the following information on the order page:

  • Contact method: e-mail address and telephone number;
  • You have the possibility to enter a discount code;
  • You will need to fill in the following data: country/region, first name, last name, company (optional), block-house-apartment details, postal code, locality, county, telephone number, payment details, and payment method. Also, you have the option to check the box with the message "Save my information for faster checkout" where you will re-enter your telephone number;
  • You will check the box regarding the acceptance of the Privacy Policy;
  • You will check the box regarding the acceptance of these Terms and Conditions.
  • To make the payment, you will need to press the "Pay now" button.

6.11. Order confirmation: After sending the order to us, you will receive a confirmation e-mail that we have received your order. The order is considered confirmed at the moment you receive the order shipping e-mail.


7. PRODUCT PRICES, BILLING AND PAYMENTS

7.1. We reserve the right to modify product prices without prior notice. The purchase price printed on the invoice will be the same as at the time of order confirmation.

7.2. Also, our company may display products on the SITE that benefit from promotional prices during a certain period of time and within the limits of available stock. Details about these promotional campaigns will be made public by display on our SITE in a distinct section.

7.3. Prices displayed on the SITE that are struck through represent the old price of a product that is in a promotional campaign and currently benefits from a lower promotional price.

7.4. Expenses related to transport are paid separately. More details about delivery costs in the delivery / return section.

7.5. Each delivered package will also contain the fiscal invoice for the ordered products.

7.6. Billing for purchased products is done exclusively in RON.

7.7. Fiscal invoices can be issued to a natural or legal person.

7.8. In certain cases, our company may request the Buyer to pay a part of the invoice value related to the order in advance.

7.9. Payment for ordered products can be made: cash on delivery or online by bank card or through shopPay or GPay. Thus, the following should be considered:

  • Cash on delivery (in cash) upon order delivery. Payment will be made to the courier company based on a receipt.
  • Online with any Visa, MasterCard, Amex, or Union Pay card (payment through the Shopify Payments payment processor), the transaction fee will be 0%.
  • Before finalizing the Order, the Buyer will need to choose the means of payment. If you choose payment by card, you will need to enter the card details: card number, expiration date, security code, and the name on the card. Processing of card data will be done exclusively on the servers of the payment provider, which offers a fast, solid, and secure transaction solution through SSL Security certificates. For more details about the payment platform, please access its website and related policies. All card transactions are secure and encrypted.
  • In case of online payment, the transaction will appear on the bank statement in the name of BIRUINȚA OLTENIEI COOPERATIVA AGRICOLĂ. Also, any payment by bank card will be confirmed at the moment the invoice is issued to the Buyer; until that moment, the order value will be blocked on the Buyer's account without being transferred to the Seller's account.
  • The Seller does not assume liability for other additional costs incurred by the Buyer following bank card transactions (example: currency conversion fee if the card issuance currency is different from RON, other fees depending on the policy of each bank, etc.), the Buyer being solely responsible.
  • In case the online payment by bank card occurred by mistake, the transaction can only be cancelled by phone, by contacting a representative of BIRUINȚA OLTENIEI COOPERATIVA AGRICOLĂ, and the amount can be returned within a maximum of 30 days from the completion of the order cancellation procedure.


8. DELIVERY OF GOODS

8.1. Details regarding the delivery of goods can be found in the Shipping Policy.

9.1. 6 months from the manufacturing date inscribed on the packaging.


10. PRODUCT RETURNS

10.1. Details regarding the return of goods can be found in the Return Policy.


11. VISITOR/BUYER OPINIONS

§ All Visitors/ Buyers who access the site can express their opinion regarding the products sold on our Site.

§ The information/comments submitted by them, positive or negative, will refer strictly to the characteristics of the products and will be published on the site after prior approval by our company representatives.

§ Thus, every Visitor/ Buyer who wishes to express their opinion about certain products will need to comply with the following:

§ to make references only in the Romanian language about the product characteristics, avoiding information about price or certain promotional offers, or information about the fulfillment of the Order placed on the SITE;

§ to use appropriate language that does not offend and not use terms that may insult or affect other Visitors/ Buyers;

§ to not publish on the site comments with illegal, obscene, threatening, defamatory content, which violate intellectual property rights or contain viruses, texts representing certain forms of mass advertising or any other form of spam;

§ to not register information or details about other commercial sites carrying out the same commercial activity, or mention comparative prices for products on the site.

§ By registering information/comments on the SITE, Visitors/Buyers grant the Seller the non-exclusive, unlimited, free, and re-transmissible right to use, reproduce, modify, adapt, publish, as well as the right to further distribute these data in the explicit or implicit marketing interest of our company.

§ Besides the opinion about a product, the Visitor/Buyer will be able to make an evaluation, also adding a relevant Rating for that product. These individual Ratings will influence the overall Rating of the product expressed through the 5 stars appearing at the bottom after the product description. Thus, a high Rating will lead to an increase in the overall Rating, and a low Rating leads to a decrease in the overall Rating.


12. CONFIDENTIALITY

12.1. BIRUINȚA OLTENIEI COOPERATIVA AGRICOLĂ is a personal data operator and will maintain the confidentiality of the data you provide: first name, last name, email, phone number, delivery address, company, as the case may be. At the same time, the Seller will ensure the security of the data provided and will take technical and organizational measures for their efficient management, strictly for the purposes declared in this contract.

12.2. Data are processed for the following purposes:

-  Order registration and confirmation;

-  Invoice issuance and payment verification;

- In cases of delivery to the courier (for order shipment), the necessary data will be transmitted to the courier company;

13. LIABILITY

13.1. The Seller reserves the right to periodically update and modify the Site Terms and Conditions to reflect any changes in the way and conditions of the Site's operation or any changes in legal requirements. The document is binding on Visitors/ Buyers from the moment of display on the Site. In the case of any such modification, we will display the modified version of the Document on the Site, for which reason please periodically check the content of this Document.

13.2. Buyers assume full responsibility in case of disclosing personal data to third parties; our company cannot be held responsible in the event a Buyer is prejudiced in any form by a third party claiming to be a representative of the Seller or representing its interests.

13.3. The following actions upon the site, its content, or upon BIRUINȚA OLTENIEI COOPERATIVA AGRICOLĂ will be considered an attempt at fraud or fraud:

  • accessing any type of data of a Visitor/Buyer by any method;
  • altering or modifying the SITE content or any correspondence sent through any means of communication by BIRUINȚA OLTENIEI COOPERATIVA AGRICOLĂ to the Visitor/Buyer;
  • affecting the performance of the server on which the SITE www.biruintaolteniei.ro runs;
  • accessing or disclosing to any third party who does not have the necessary legal authority any content sent by BIRUINȚA OLTENIEI COOPERATIVA AGRICOLĂ to the Visitor/Buyer, when they are not the legitimate recipient of the content;
  • In any of the situations above, BIRUINȚA OLTENIEI COOPERATIVA AGRICOLĂ reserves the right to address the competent authorities. Fraud and attempted fraud are punished according to the criminal legislation in force, and the prejudiced parties may seek compensation in court for moral or pecuniary damages, as the case may be.
  • Also, in case of suspicious transactions or those declared suspicious, at the request of any public authority, authorized institution, partner banking unit, the Seller has the obligation, and the Buyer gives their consent, regarding the communication of personal data.


14. DISPUTES

14.1. This contract is subject to Romanian law. Any disputes arising between the Seller and Visitors/Buyers will be resolved amicably or, if this is not possible, the disputes will be resolved by the courts of law provided by civil legislation.
